ADMINISTRATIVE ORDER NO. 6-14.0

PROCEDURE FOR THE FIRST APPEARANCE HEARING OF PARENTS ARRESTED
IN JUVENILE DELINQUENCY CASES FOR THE NON-PAYMENT OF RESTITUTION,
COURT COSTS AND ATTORNEYS’ FEES

 

WHEREAS, it is necessary for the court to set a procedure whereby parents arrested on the basis of their children owing money for delinquency cases in the form of restitution, court costs and attorney’s fees are brought to court for a first appearance hearing; it is

ORDERED that:

In cases where a parent of a juvenile is arrested on a warrant based on non-payment of restitution, court costs and/or attorney’s fees, the identifier will be that the case number begins with "JL".

The first appearance hearing (FAH) for such cases shall be heard by a Hearing Officer along with first appearance hearings on child support warrants and/or civil contempt writs.

Excluding holiday conflicts, if the arrest on a "JL" case occurs on Sunday through Thursday, the FAH will be done on the next day at 1:15 p.m.

If the arrest on a "JL" case occurs on a Friday or Saturday, the defendant will attend weekend FAH. The weekend judge may reduce the purge amount so that the defendant may purge. If the defendant does not pay the purge amount to be released, they will be brought back to the next regularly scheduled Department of Revenue FAH. Weekend FAH paperwork should reflect either the reduced purge amount and/or a new court date set for the next regularly scheduled Department of Revenue FAH.

In the event a holiday interferes with the above schedule, the defendant will be brought to the FAH falls within 24 hours of their arrest.
