APPENDIX G TO ADMINISTRATIVE ORDER NO. 5-40.1
DOMESTIC VIOLENCE EVALUATIONS
Domestic violence evaluations may be performed by licensed mental health counselors, clinical social workers, marriage and family therapists, and clinical psychologists.
Evaluators may provide treatment intervention programs, but shall not refer and/or admit clients to the evaluator=s own program for individuals whom the evaluator has performed a court-ordered domestic violence evaluation, except by Court order. The evaluator shall forward a copy of the completed initial first-tier evaluation to the court or agency which referred the case and to the client=s subsequent treatment provider.
Each initial first-tier evaluation will cost up to $75 and will include a review of the following:
1. Personal data;
2. Marital history;
3. Legal history, including criminal record and documents petitions or charging documents from the case that resulted in the court-ordered assessment;
4. Psychological and medical history;
5. Social history;
6. Relationships;
7. Drug and alcohol history; and
8. Employment history.
After a review of the foregoing, the evaluator may decide that a more in-depth evaluation is in order and may recommend that the Judge require an evaluation that includes utilization of objective instruments. The evaluator may perform the further evaluation if the Court orders it or it is authorized by the referring agency pursuant to Court order, and the evaluator is otherwise qualified to perform such evaluations. There is no set fee for this second-tier evaluation except as provided in paragraph 6 of this Administrative Order.
Treatment recommendations must be consistent with the standards established by this Administrative Order, and may include:
Statutory Batterers= Intervention Program
Anger Management
Intermediate Batterers= Intervention Program
Domestic Violence Education Program
Anger Management Program for Juvenile Offenders
Domestic Violence Program for Families when the Offender is a Juvenile
Domestic Violence Education Program for Victims
Substance Abuse Treatment
Mental Health Treatment
Further Evaluation
Other
If the evaluator recommends treatment other than the Statutory Batterers= Intervention Program, the evaluation shall include a written rationale for recommending alternate treatment, and such written rationale shall be submitted to the Court for inclusion in the Court file.
