IN AND FOR POLK, HARDEE AND HIGHLANDS COUNTIES, FLORIDA

ADMINISTRATIVE ORDER NO.5-4.0

PROCEDURES REGARDING CHILD SUPPORT PAYMENTS WHERE

SUBJECT CHILDREN RECEIVE PUBLIC ASSISTANCE

 

WHEREAS Section 409.235 F.S., enables certain families with dependent children to receive public assistance in the form of AFDC (Aid for Dependent Children) funds; and

WHEREAS Section 409.2561 F.S., provides for assignment to the Department of Health and Rehabilitative Services of court ordered child support obligations up to the amount of public assistance paid for as long ass public assistance monies are paid; accordingly it is

ORDERED AND DIRECTED:

1. THAT in all petitions previously filed and filed hereafter, the Department of Health and Rehabilitative Services will be designated ass payee of all child support actions, whether civil or criminal, in all courts of this circuit, when it is made known to the respective clerks by receipt of a certified affidavit from an agent of the Department of Health and Rehabilitative Services in each individual case that the child or children for whom support payments are ordered is, or are, recipients of public assistance under the Aid to Families with Dependent Children (AFDC) program. The respective clerks, upon receiving said certified affidavit, shall file the same, along with a copy of this order, in the case so affected, and shall thereafter forward to the Department of Health and Rehabilitative Services (Child Support Enforcement Unit, Post Office Box 2050, Jacksonville, Florida 32202) or their designated agent any support payment received by the clerks pursuant to said court order.

2. THAT when said recipient is no longer receiving AFDC payments, a notification letter to the clerk of the court from the Department of Health and Rehabilitative Services shall serve to redirect payment from the Department of Health and Rehabilitative Services to the individual for whom payments are being made.
