IN THE CIRCUIT COURT OF THE TENTH JUDICIAL CIRCUIT

IN AND FOR HARDEE, HIGHLANDS AND POLK COUNTIES, FLORIDA

This Court has determined that Circuit Judges assigned to a Civil Division may decide that conducting a uniform motion calendar would well serve judicial economy and encourage the earliest resolution of cases. If such is the case, it is, therefore ORDERED as follows:

1. Circuit Judges in each section of the Civil Division, in each County of the Circuit, may conduct a uniform motion calendar on days and at times specified by that judge.

2. The party or the attorney noticing a motion to be heard on the Uniform Motion Calendar shall contact opposing counsel and make a good faith attempt to resolve the matter without judicial involvement. Said party or attorney shall sign a certificate to that effect which shall be attached to the motion.

3. Hearing shall be limited to a total of ten (10) minutes per case. If there are two parties, each side shall be allotted five (5) minutes. If there are more than two parties, the Court shall allocate the time. No matter how many parties, the court's time for reviewing the documents, memoranda, etc., is included in the total time of the movant relying on said documents. Also, included in the total time is any set up time required for the court reporter.

4. The moving party shall make arrangements with the clerk's office to have the court file brought to the hearing or each party shall furnish the court with a copy of all pertinent pleadings, memoranda, etc., which they wish the court to consider. The court file and its contents will not be provided automatically to the court. The moving party must provide the clerk, the court and opposing party/counsel with a copy of the motion and a copy of the notice of hearing no less than five (5) working days prior to the Uniform Motion Calendar. The moving party shall give reasonable notice to the opposing party.

5. Counsel shall sign up with the bailiff assigned to the judge conducting the uniform Motion Calendar. Attorneys shall sign up only when all are present and ready to be heard for a particular case. (Do not sign up if the attorney is not present. If you are not present when your case is called by the Bailiff, you forfeit your hearing time. No hearings will be conducted by telephone. No hearings requiring testimony shall be noticed.)

6. No petitions for Rehearing, Reconsideration or the like nor any Motion to Disqualify the Judge nor any matters not assigned to that judge's section shall be heard on the Uniform Motion Calendar. Any attorney/party scheduling an inappropriate hearing on the Uniform Motion Calendar shall be subject to sanctions. The purpose of the Calendar is to assist in the timely disposition of discovery issues so as not hinder the ultimate resolution of lawsuits.

Administrative Order No. 3-22.0 entered June 27, 1995 is hereby VACATED.
