TENTH JUDICIAL CIRCUIT COURT
FOR HARDEE, HIGHLANDS AND
POLK COUNTY, FLORIDA

County Case No. MM99-00277A-XX
Appeal No. 99-53
April 14, 2000

ROBERT LEE MOORE,

Appellant,

vs.

STATE OF FLORIDA,

Appellee.

OPINION OF THE COURT

This is an appeal from the county court of Highlands County, Judge Olin Shinholser presiding. Appellant, Robert Lee Moore, seeks to withdraw his plea of guilty to resisting an officer without violence. This court has jurisdiction. Fla. R. App. P. 9.030(c). The ruling of the county court is affirmed.

The trial court appointed a public defender to represent Appellant for purposes of appeal. Counsel for Appellant states the he has read the record on appeal and finds no arguable points of law. Anders v. California, 386 U.S. 738 (1967). After notice and opportunity, Appellant failed to file a pro se brief. This court has reviewed the record and finds no evidence that Appellant ever motioned the court to withdraw his guilty plea, nor any other meritorious point of appeal.

Accordingly, it is ORDERED that the ruling of the trial court is AFFIRMED.

ORDERED 14 April 2000.
