THE TENTH JUDICIAL CIRCUIT COURT
FOR HARDEE, HIGHLANDS AND
POLK COUNTY, FLORIDA
Appeal No: BB-31
Case No: MM98-02688A-LD
WILMA FAY PARKS,
Appellant,
vs.
STATE OF FLORIDA,
Appellee.
OPINION OF THE COURT
This is an appeal from the county court of Polk County, Judge Steven Selph presiding. This court has jurisdiction. Fla. R. App. P. 9.030(c)(1)(A). The ruling of the county court is affirmed.
Appellant, Wilma Fay Parks, appeals the ruling of the trial court which found her guilty of petit theft. The public defender filed an initial brief on behalf of Appellant stating that the record below contains no meritorious grounds for appeal. Anders v. California, 386 U.S. 738 (1967). In his initial brief, defense counsel argued that the decision of the trial court turned upon the credibility of witnesses, and as such is unappealable. After notice and opportunity, Appellant failed to file a pro se brief. This court has conducted its own review of the record for possible errors and has found no reversible error.
It is ORDERED that the judgment and sentence of the trial court are AFFIRMED.
ORDERED December 1999.
