IN THE CIRCUIT COURT OF THE TENTH JUDICIAL CIRCUIT
IN AND FOR HARDEE, HIGHLANDS AND POLK COUNTIES, FLORIDA
ADMINISTRATIVE ORDER NO. 4-7.2
RE: GUARDIANSHIP EDUCATION REQUIREMENTS
WHEREAS, Guardianship Education Requirements are set forth in §744.3145, Florida Statutes; and
WHEREAS, that statute allows the individual courts to exercise discretion in imposing additional requirements or waiving some of the requirements; and
WHEREAS, this Court has determined that the requirements may be met by observing an educational video available from the Clerks offices in each county; and
WHEREAS, certain procedures need to be set forth for the handling of these videos; it is hereby
ORDERED that the following charges in Hardee, Highlands and Polk Counties are due upon rental of the video and the deposit will be refunded upon the video being timely returned in satisfactory condition:
RENTAL FEE (NON -REFUNDABLE) $50.00
DEPOSIT FEE $25.00 (Each clerk, in his or her discretion, may waive the requirement of a deposit)
POSTAL FEE (IF NEEDED) $ 8.50
Married couples appointed simultaneously in the same guardianship are allowed to view the same video for one rental fee. In indigent situations, the deposit fee and postal fee (if needed) may be waived at the Clerk's discretion. Expenses incurred by the guardian may be paid from the ward's estate, unless the Court directs that the guardian pay the expenses individually.
In order for the deposit fee to be refunded, the video is required to be returned in satisfactory condition as follows:
LOCAL/PICK-UP AT PROBATE 1 WEEK
MAILING REQUIRED 2 WEEKS
After viewing the video, the guardian shall execute an affidavit of completion under oath to be filed with the court. A certificate of completion shall be issued upon the filing of the affidavit. The original certificate of completion shall be filed in the court file. The guardian shall be responsible for filing a copy of the certificate of completion in each court file of appointment.
Administrative Order No. 4-7.1 is hereby VACATED.
