IN THE CIRCUIT COURT OF THE TENTH JUDICIAL CIRCUIT

IN AND FOR HARDEE, HIGHLANDS AND POLK COUNTIES, FLORIDA

ADMINISTRATIVE ORDER NO. 2-64.1

IN RE: FIRST STEP, INC.

WHEREAS, First Step, Inc. of Polk County, a non-profit corporation, has been created and established in the Tenth Judicial Circuit; and

WHEREAS, the primary purpose of such corporation is to assist in the rehabilitation of persons placed on supervised probation within the jurisdiction of the Tenth Judicial Circuit by providing to such persons ancillary services such as, but not limited to, employment, counseling, education, training, and related services, assistance and opportunities; and

WHEREAS, Section 948.039(2), Florida Statutes, provides that court determined conditions of probation or community control may include that the offender or probationer in community control "pay not more than $1 per month during the term of probation or community control to a nonprofit organization established for the sole purpose of supplementing the rehabilitative efforts of the Department of Corrections"; it is therefore

ORDERED as follows:

1) Each defendant within the Tenth Judicial Circuit sentenced to a term of probation supervision by the Department of Corrections shall pay as a related cost the sum of one dollar ($1.00) per month during the term of probation or community control. Such monies shall be paid in accordance with the terms as set forth in the Monetary Obligation Order.

2) Each judge of the Tenth Judicial Circuit shall make the payment set forth in section one a condition of all orders of probation or community control unless such judge makes a written finding of fact as to why such condition would not be in the best interest of justice.

3) The imposition of this cost shall be orally pronounced at sentencing and shall be contained in the written sentencing order.

4) Monies collected pursuant to this Order shall be used for the benefit of those individuals under supervision of the Department of Corrections as set forth in the bylaws of First Step Corporation of Polk County, Tenth Judicial Circuit.

4) No monies collected pursuant to this Order shall be used for costs of supervision, court costs, fines or any other court ordered payments.

Administrative Order No. 2-64.0 is hereby VACATED.
