ADMINISTRATIVE ORDER NO. 2-51.0
IN RE: FILING OF MOTIONS IN FELONY CASES
BEFORE ASSIGNMENT OF CASE NUMBER BY CLERK
WHEREAS Fla. R. Crim. P. Rule 3.090 entitled Pleading Captions states, in part that "(e)very pleading, motion, order, judgment, or other paper shall have a caption containing the name of the court, the file number..."; and
WHEREAS it is necessary for pretrial release motions and pleadings to be filed before the time required by the Clerk of Court to assign matters a case number; and
WHEREAS it is the desire of the Court that these motions and pleadings be filed in a timely manner in an effort to alleviate the jail overcrowding situation; it is hereby
ORDERED that:
1) Before the time that the Clerk assigns a felony case number to a matter, any pretrial release motion or pleading may be filed using the law enforcement agency case number in lieu thereof; and
2) The Clerk shall accept the filing and the Court will process the motion or pleading; and
3) The Clerk shall assign the matter an official case number at the earliest possible time.
4) This Order shall be effective upon entry.
